The US Government's Food and Drug Administration has caved-in to the Breast Implant Industry by giving the billion dollar safety approval to silicone gel breast implants.
The HumanticsFoundation and Ilena Rosenthal's opinion on this ill advised decision mirrors the views so well expressed here by:

concluded: "The FDA has never rescinded approval for a medical device
after it has been approved, but that's not going to stop NOW from
trying. When the new Congress takes office we will petition our
representatives to initiate an immediate review of the FDA and this
dreadful, dangerous decision."

In
the Fall of 1995, having nary a clue what could spring forth from this
action, I created the first public newsgroup for women harmed by these
dangerous products.
My goal was to create a support group for women to connect together.
Almost immediately, I became a target for the breast implant industry and their vast public relations teams
on the Wild West of the Internet ...Usenet. I was immediately attacked
by Patrick O'leary ... then Vice President and later President of

Since
January, 2001, I have been the defendant in a classic Industry VS
Activist SLAPP suit intended to silence my voice and exhaust my
resources. their vast public relations teams.
November
20, 2006, the Supreme Court of California released their unanimous
opinion that I prevailed against the third plaintiff ... Terry Polevoy.
Lower courts had previously ruled that neither Stephen Barrett nor attorney, Christopher Grell had any case against me.
In fact, I had never mentioned Grell's name until he SLAPP sued me for libel.
This
ruling is an important one for internet providers and hosts of internet
chat groups and blogs and individual posters such as myself.
Previously, the threat or reality of being sued for what a subscriber
posted, could seriously limit open discussions. Much of what is posted
on the internet is the work of others. This threat being erased will
invigorate discussions on controversial topics ... including breast
implants and health freedom.
In fact, the (losing) plaintiffs in this case have a history of suing
and of threatening critics with long, expensive litigation such as this
one, for merely posting the words of another. They intimidate talk show
hosts and ISP's and blog owners with threats of lawsuits in attempts to
control messages with which they disagree.
This ruling will shut down meritless suits such as these, designed to intimidate into silence those with conflicting opinions.

The breast implant industry, for the same economic reasons as the global warming deniers, use industry or junk
science strategies to confuse the public and create doubt in their
minds. The cell phone, vaccination, aspartame, tobacco industries and

The Six Sins of the Wikipedia by Sam Vaknin ... this
well describes my experiences with the Healthfraud group. The would
revert an edit of mine within nanoseconds, and they use anonymous
'editors' to put the Healthfraud/Quackwatch viewpoint as fact.
Excerpt: As recent events clearly demonstrate, the Wikipedia
is a hotbed of slander and libel. It is regularly manipulated by
interns, political staffers, public relations consultants, marketing
personnel, special interest groups, political parties, business firms,
brand managers, and others with an axe to grind. It serves as a
platform for settling personal accounts, defaming, distorting the
truth, and re-writing history.
Ilena Rose, who runs the HumanticsFoundation, said she believes surgeons who deny that silicone breast implants cause health problems are simply motivated by money.

I've had a whole education in Wikipedia the past couple of weeks.
A couple of friends had written to advise me that Barrett Vs Rosenthal was being covered on Wikipedia.
What I read was basically unrecognizable as to the unanimous opinion of
all seven justices in the Supreme Court of California I just won
against the Quackbusters ... Stephen Barrett, Terry Polevoy and
attorney Christopher Grell.
When I began to correct the errors and upgrade the information, I was immediately pounced upon by Paul Lee (fyslee on Wikipedia) ... Stephen Barrett's Assistant Listmaster for the Healthfraud List. (Update as of 12/20/2006 ... Paul Lee, after several years, has quit his job as Assistant Listmaster to the Healthfraud List.)
Here
is a partial list of various operations of Barretts. He has layers of
people bullying his viewpoint as facts on the internet ... whether
blogs, Usenet, or Wikipedia. He calls himself the "Director of Internet Operations" of NCAHF, and indeed he does direct and operate!
(Update
of 12/23/2006 ... a couple of days ago on Barrett's Healthfraud List a
Call to Arms was put out ... claiming that Barrett and NCAHF were being
unfairly portrayed. In response, his teammates have inudated Wikipedia, rewriting history again and making the Barrett entries look like just more advertising for Quackwatch / NCAHF.
Paul
Lee is also a member of the Rag-tag Posse of Snake-oil Vigilantes.

He
also is "Ringmaster" for 90 related Quackwatch/NCAHF blogs and
websites, as well as appears to have infinite time to "edit" many, many
articles on Wikipedia ... always with QuackWatch / NCAHF bias or POV (point of view).
Everytime I made an edit, immediately (and I mean oft within just seconds) Lee was reverting to what Barrett wanted the world to believe was a fact.
He also reverted every edit I made as as well regarding the so-called
National Council Against Health Fraud ... including the fact that there
were still operating and collecting donations even though the State of
California had suspended their Corporate status over 3 1/2 years
ago! (Update as of 12/23/2006 ~
consensus was reached and suspension notice was linked. They have
fought long and hard to keep this very vital fact off the net.)
Then someone I had basically no experience with, named ArthurRubin, temporarily banned me when I replaced the totally notable link to NCAHF's corporation suspension. (Update of 12/23/2006 ~ Arthur
has mellowed and promises not to ban me anymore. He admitted he was
biased against me for posting on the Usenet group, misc.legal. I looked
it up and he had posted the totally junk science / industry viewpoint
that implant lawyers are getting rich and that 'science' has not proven
any links to silicone and disease.)
They claimed I was biased ... and they, calling themselves, "Wikipedians Against Quackery" ... totally and utterly unbiased.
As usual ... it's upside down, backwards, and inside-out.
What
that seems to indicate, is they have had some divine intervention and
hold the deluded belief that THEY are the appropriate judges as to who
is, and who is not, a quack.
Stephen Barrett also has made that ridiculous claim.
In
fact, Judge Richmond expressed in the Superior Court ruling against all
3 plaintiffs, that who is and who is not, a "quack" is NOT the dominion
of Stephen Barrett or anyone, but an opinion.
After I wrote about Rubin and Lee on my blog, up popped Ronz,
who erases every trace of evidence that shows that Barrett's NCAHF has
no apparent legal corporate status ... if he was unbiased, there would
be no reason for him to erase these facts. He is their perfect
distraction shill ... claiming that NCAHF's distraction, or "POV"
(point of view.)
ArthurRubin(who definitely has leaned toward being a mensch now) using typical Healthfraud Humility, regarding the Supreme Court's decision that Polevoy just lost, claimed:
I posted the following on the NCAHF page on Wikipedia ... not my point of view but verifiable facts under the criticism section of the NCAHF. This was considered by Rubin a "personal attack" and repeatedly removed.
The corporate license of NCAHF was suspended by the State of California in 2003. [6] No listing in Massachusetts under this name has been found to indicate NCAHF has legal status in Massachusetts.[7]
Because
they kept censoring me, I just called the Massachusetts Secretary of
State and was told there is no legal entity under National Council for
Health Fraud. The Attorney General's office reiterated this.
Since
October, Paul Lee has promised the Wikipedian editors that he would
provide proof of the legal corporate entity of NCAHF that collects non
profit donations from Healthfraud Bob Baratz's Skin Clinic.
To
date, December 23, 2006 he has provided none, just keeps repeating they
are a legal California corporation (they are not.) Click here for the California Corporate Listings since 2003, when they were suspended.
What
I have found is incredible pressure put on anyone who goes against
industry propaganda ... from the breast implant industry to the
quackery industry of Barrett and NCAHF ... with their corporate
viewpoints strongly being bullied even on Wikipedia.
Without
consensus, a few decided that my critical website of Quackwatch/NCAHF
was not to be posted, although there are five different critical links
from Barrett on Dr. Clark's Wikipedia.
Further,
it was decided (without consensus again) to remove the fact that Barret
had flunked his psychiatric boards in the 1960's and never passed them
in the decades he 'practiced.'
These facts were revealed under oath at a deposition in another Barrett SLAPP suit ... Barrett's loss to Dr. Tedd Koren.
This
is highly significant as for years, Barrett sold himself as an expert
in many things and operates "Credential Watch" ... with his biased and
slanted viewpoints of who gets targeted.

I wanted to thank Dr. Zuckerman (and a few other power editors) for their courage and tenacity to make the Wikipedia article on breast implants as factual as possible. If the industry had their way, Wikipedia would be just another biased PR / advertising tool.

It's
been a wild couple of weeks since the Supreme Court of California
announced their unanimous decision in my favor in what is now known as Barrett Vs Rosenthal on November 20, 2006.

The 7 Justices ruled that the re-posting of potentially libelous material on the internet is not actionable.
For
the last years, ISP's and bloggers and others have been threatened and
been sued for the words of someone else ... and this decision sets
precedence behind these types of suits, typically filed to silence
critics by intimidating them with expensive, energy consuming
litigation.
As
the lower courts correctly concluded, however, none of the hostile
comments against Dr. Barrett alleged in the complaint are defamatory.
Almost immediately, their revenge began.
Wikipedia is supposed to be an encyclopedia, a non-biased resource posting only facts.
After receiving messages that the Healthfraud Team on Wikipedia false "facts" about this case, I began correcting the errors and total Barrett bias in reporting.
I
thought only facts were to be reported, but instead I was immediately
attacked by Paul Lee, Barrett's "assistant listmaster" on the
Healthfraud List and ArthurRubin, censoring my corrections to the false information they were posting.
Both
admit to being members of the "Wikipedians Against Quackery" ...
another layer of Barrett's "Anti-Quackery" Empire. From my first
correction to their inaccurate "facts" regarding Barrett Vs Rosenthal,
Lee and ArthurRubin attempted to ban me.
What I've learned since Wednesday is that Barrett's Team is even attempting to bully their viewpoints onto Wikipedia ... changing history to make them better and censoring the facts.
This
includes Barrett's losing lawsuits, his mad attacks against alternative
practictioners and practices, his own NCAHF, suspended by the State of
California etc.
Paul
Lee is definitely not 'unbiased' in any manner ... he and Barrett
co-promote each other's websites, blogs, and lists. Click rag-tag posse
link below.
Coleah Penley Ayers, who has aligned with both Eurosilicone head, Patrick O'leary, and Terry Polevoy,
revamped her hateful website she purchased of my name. It is so full of
lies and even libelous statements, it would take days to correct them
all. She also filled the board with off topic political postings ...
one of the industry tricks to get attention off the topic of breast
implants. It was Coleah who ruled the SBI Private Club,
working with various Posse members to hire a Private Investigator to
hunt me down while Polevoy was obsessing about my whereabouts. She also
went to Costa Rica, one of the locations they know I enjoy.
Terry Polevoy immediately posted more theats that he intended to sue me again.
He also obsessed about an interview about the case on Break for News,
and Penley Ayers posted the transcript he made. Their silly comments
about me made them look even more ridiculous. For those interested in

Victory for Freedom of Speech

Willa Nidiffer,
began circulating webpages claiming that I had filed for bankruptcy,
and that I had been arrested in San Diego, CA. She calls herself Barrett's Parrot.
This
mirrors her behavior when Barrett and Grell lost all of their appeals
in October 2003. At that point, they began circulating pages claiming
that I had been arrested for selling crack cocaine to children in San
Jose, Costa Rica. She is one of the Posse members and calls herself
"disinfoagent@disinfo or nanaweedkiller."
Concurrently, other members of this Posse, notably Paul Lee, began to rewrite case history on Wikipedia.
I'm working with others to get the facts accurate while Lee is
attempting to control all the information around the case by throwing
me off Wikipedia.
The Posse members on Usenet went wild in their attempts to change history. Mark S Probert,
a former attorney disbarred by the Supreme Court of New York in 1992,
was the most visible. Peter Moran, from the Healthfraud list, repeated
and repeated and repeated the disinformation that Barrett and Polevoy
had been libeled ... exactly opposite of the court ruling.
Christopher
Grell, the attorney and a plaintiff in this case, had the poor legal
judgement to falsely publish that my comments had been proven to be
libelous, in direct contrast to every ruling. Very poor judgment he
made.

San Francisco - In what is a victory for free speech on the Internet, the California Supreme Court ruled today that no
provider or user of an interactive computer service may be held liable
for putting material on the Internet that was written by someone else.
Today's
ruling affirms that blogs, websites, listservs, and ISPs like Yahoo!,
as well as individuals like defendant Ilena Rosenthal, are protected under
Section 230 of the federal Communications Decency Act (CDA), which
explicitly states that "[n]o provider or user of an interactive
computer service shall be treated as the publisher or speaker of any
information provided by another information content provider."
Excerpt: Rosenthal did not return a call for comment Monday but said on a website that she was gratified by the ruling. She described the litigation as "exhausting" and said it was "intended to silence my voice and exhaust my resources."
Click

Barrett, and Christopher Grell teamed with their "rag-tag posse." This
team was formed to harass and attack on the internet, we defendants of
approximately 40 SLAPP suits filed around the country by the so-called quackbuster team.
It
is my understanding that in six years of various litigation, they have
won none of these suits, designed to waste the resources of the
defendants and divert their energies to defending themselves.
One
defendant, Dr. Mercola, had two suits filed against him by Barrett ...
the first Barrett dropped days before the hearing, causing enormous
expense to Dr. Mercola. The second time Barrett sued him, Dr. Mercola
settled so that he could continue his work instead of spending his time
defending himself. Even after receiving money from Dr. Mercola,
Barrett's team continued their vile public attacks on him.
